All booked Excursions that require a deposit are NON-REFUNDABLE.  All Excursions paid for in advance and all gift cards expire 1 year from the date of purchase.  The reason for this is to allow enough time for all paid in full Excursions to be taken in a timely manner, yet allow for new Excursion seekers an opportunity for the fallowing season.   All anglers must sign a liability release form before beginning their Excursion. The release form may be previewed below. It is a waiver releasing In the Hills Fishing Excursions from any liability of injury to anglers or their equipment.

IN THE HILLS FISHING EXCURSIONS GUIDE SERVICE AGREEMENT AND RELEASE   Guide ____________________              1 Angler    2 Anglers    3 Anglers Date_____________________               ½ Day                        Full Day Trip Leader______________                 Float                          Wade River/Section_______________            Time_____________   -   _____________                   The undersigned hereby enters into this Agreement upon the date set forth above, with In the Hills Fishing Excursions upon the terms and conditions hereinafter set forth.  THIS DOCUMENT CONTAINS A COMPLETE RELEASE OF LIABILITY SEPERATELY SET FORTH BELOW.                   The undersigned has hired In the Hills Fishing Excursions to provide fishing guide services.  The guide services may be conducted on private or public lands, including lands under the jurisdiction of the United States Department of Agriculture, US Forest Service.  With respect to guide services conducted on private property, the undersigned acknowledges and agrees that this Agreement and Release shall also include all owners of such private property.                   The undersigned recognizes that fishing activities may entail certain hazards which are inherent in the sport.  The guide services may include hiking, climbing, upon river banks and other strenuous activities; wading on rocky or slippery river bottoms and in water which may be fast moving and cold, floating on rivers which may include rapids and other navigational hazards; the use of equipment which, if improperly used or broken, could cause injury, including hooking injuries; and other activities incidental to outdoor sports which may present risks of injury or to the health of the undersigned.  The undersigned assumes the risk of all such hazards and, by execution below, acknowledges that such hazards are undertaken voluntarily and at the sole election of the undersigned.                   Because guide services may be provided on public lands un the jurisdiction of the United States Department of Agriculture, US forest Service, In the Hills Fishing Excursions is required to provide the following notification “The united States Department of Agriculture (USDA) Forest Service is a diverse organization committed to equal opportunity in employment and program delivery.  USDA prohibits discrimination on the basis of race, color, national origin, sex, religion, age disability, political affiliations and familial status.  Persons believing they have been discriminated against should contact the Secretary, US Department of Agriculture, Washington, DC, 20250, or call (202) 720-7327 (voice) or (202) 720-1127 (TTY).”                   In consideration of the provisions of guide services for the undersigned, for himself, his heirs, personal representative, successors and cosigns, hereby: 1.               Exempts, releases and forever discharges In the Hills Fishing Excursions and its respective owners officers, agents, servants, employees and lessors from any and all claims, demands, causes of action, liabilities, costs or expenses whatsoever arising out or for in any way connected with any damage, loss or injury to the undersigned or damage to the undersigned’s property occurring, which may be suffered or asserted, in connection with services and/or equipment provided hereunder, whether such loss, damage or injury results from the negligence of IN the Hills Fishing Excursions or otherwise; 2.               Agrees to indemnify and save harmless IN the Hills Fishing Excursions from and all such claims, demands, causes of action, liabilities, costs or expenses on account of any injury to third persons or damage to property during the period occasioned by or arising out of the acts of omissions of the undersigned, whether such results from or are contributed to be the negligence of In the Hills Fishing Excursions or otherwise.
